Amendments to the PFD’s 2023 Practice Guidance on Non-molestation Injunctions and Template Orders for Non-molestation Orders
Resolution’s response to the President of the Family Division.
Resolution has responded to the President of the Family Division’s amendments to the 2023 Practice Guidance on Non-molestation Injunctions and Template Orders for Non-molestation Orders. This response has been prepared by Resolution’s Domestic Abuse Committee.
The purpose of this Guidance is to address some of the practical and procedural aspects of applications under s 42 of the Family Law Act 1996, commonly known as Non-Molestation Injunctions.
Resolution members sometimes find that if a perpetrator is going to breach a NMO, they will do so regardless of the specifics of the order. But we consider that all the documents provided with the consultation really help to clarify and seek to eliminate implementation issues that have previously arisen for victims due to lack of specificity in orders. They bring the standardised order into 2025 and recognise how abuse is now sadly often perpetrated and how victims need to be safeguarded.
