In this new bitesize training course, Corker Binning, a boutique firm specialising in criminal, regulatory and international law, provide expert advice for family lawyers whose clients and cases may be impacted by criminal proceedings.
All too often, relationship breakdowns and family proceedings intersect with police investigations and prosecution. Whatever the situation, and whichever comes first, it is a useful skill for a family lawyer to have a confident understanding of criminal law, in order to react positively when trouble arises and guide clients to the next step.
This session will not be a “how to” guide to criminal law. Rather, it will assist family practitioners in recognising when specialist advice might be required and what to do if you are the first lawyer called by a client who has been arrested or is under investigation. Specifically, it will cover:
- Things to think about if your client is considering making a criminal complaint;
- Advice on what to do if your client is arrested and/or being investigated by the police;
- Protective orders and disposals available to the police;
- Information on a range of criminal offences that frequently touch family proceedings, including assaults and other related offences, harassment and stalking, controlling or coercive behaviour and new offences under the Online Safety Act (including the sharing of intimate images);
- Disclosure regimes and the process by which information can be shared between concurrent family and criminal proceedings; and
- The impact of restraint and confiscation orders in family court proceedings.
