Session 5 overview – Express Financial Remedy Procedure Pilot

This one-hour session will look at the Express Financial Remedy Procedure Pilot which came into force on 7 April 2025:  considering the policy arguments in favour of the pilot; a step-by-step explanation of how it will work in practice; and sharing any early observations on the operation of the pilot.

  • The procedural steps involved in a pilot case
  • What to do if a pilot case is no longer considered eligible
Who is this for?

This one-hour session is ideal for family solicitors who:

  • Want to understand how a pilot case will operate in practice, either because they have cases in one of the pilot financial remedy court zones or in anticipation of expansion of the express financial remedy procedure
  • Need guidance on what will be expected in terms of disclosure and expert evidence in a pilot case
  • Want to know whether there are any lessons to be learned from the first few weeks of the pilot in operation

Meet the trainers:

HHJ Stuart Farquhar

Stuart was a barrister specialising in Financial Remedies in Nottingham until 2005. District Judge in Cambridgeshire 2005-2013. Stuart was a Tutor at the Judicial College for 8 years to assist training other judges in Financial Remedies. Appointed Circuit Judge in Brighton in 2013 and has been the Lead Judge for Financial Remedies in Kent, Surrey and Sussex since 2019. Stuart chaired various committees set up by Mostyn J to consider issues relating to Financial Remedies as well as the Financial Remedies element of the Transparency Implementation Group set up by the President.

 

Sam Hillas KC

Sam Hillas KC is a senior member of SJB’s matrimonial finance team, dealing exclusively with financial remedy work. Commended by Chambers and Partners and Legal 500 as a “charismatic and client-friendly advocate” who “works like a Trojan”, Sam specialises in high net worth and/or complex cases, especially those involving marital agreements, trusts and corporate structures, cases involving non-disclosure and Schedule 1 Children Act.
As a trained arbitrator and experienced King’s Counsel, Sam is also expertly placed to chair private FDR hearings, enabling a speedy and confidential resolution to financial matters within divorce proceedings.
Sam is a bencher of Inner Temple and Attorney General of the Northern Circuit.
