Inclusion Framework and Pre-Action Model for the Digital Justice System
Resolution’s response to the Online Procedure Rule Committee.
Resolution has responded to the Online Procedure Rule Committee’s consultation on the Inclusion Framework and Pre-Action Model for the Digital Justice System.
The draft inclusion framework sets out design principles and standards to ensure all users, especially those at risk of exclusion, can access and engage with digital justice services. Key features include user-centred design, plain language and robust data collection to measure inclusion outcomes.
Resolution welcomes the recognition of the need for both non-digital and assisted digital routes as a one-size-fits all approach would not be appropriate (paragraphs 44,and 46 to 48). Those involved in family cases are likely to have particular preferences and needs, including protective needs.
Whilst we think that the principles, standards and mechanisms reflected in the draft Framework are probably right, and high expectations, standards and data standards are needed, we are not in a position to know how willing and able private and third-party providers will be able to meet them, and on what timeframe, especially without any public funding or incentives, and whether they will simply not take part or fall away from interfacing with the justice system.
