In ADR situations, couples need to understand the value of business assets held by them and the possible tax cost of transfers between them, or disposals of, of business and other assets. It’s in no one’s interest for HMRC to be one of the beneficiaries of a divorce settlement, if this can be avoided. I’ve been collaboratively trained and have participated in collaborative 5-ways and in mediations, helping to explain to both parties and their advisors, where appropriate, the implications of proposed transfers and sales, as well as discussion of other options that may be available to the parties.
