Roger Isaacs is an experienced forensic accountant and Chair of the Forensic Advisory Committee of the ICAEW. He has given expert witness accountancy evidence in over 100 family cases and will share some of his experiences of the common pitfalls for instructing solicitors and how to avoid them. He will also give an introduction to Resolution’s newly published guidance for those making initial enquiries of experts in financial remedy proceedings.

This talk will cover strategies for responding to deliberate disposal of assets in family finance cases. How to prevent it from happening (s 37 injunctions) and what you can do for your client if it does happen (rescission and compensation).

What are needs? How do the courts assess needs? At what level should needs be met? How does the parties’ standard of living during the marriage affect needs? For how long should needs be met? When is sharing and compensation to be taken into account? This talk will examine these and other issues involved in the assessment of ‘needs’ in the light of the Family Justice Council’s ‘Guidance on Financial Needs on Divorce’ and recent case law.
